Terms of Service and Booking Agreement for RehealMHA

1. Acceptance of Terms

By booking an appointment or purchasing services from RehealMHA, you ("Customer," "you," or "your") agree to be bound by these Terms of Service and Booking Agreement. If you do not agree to these terms, please do not book or use our services. These terms constitute a legally binding agreement between you and RehealMHA.

2. Appointment Booking and Confirmation

All appointments must be confirmed at least 24 hours in advance. RehealMHA reserves the right to cancel, reschedule, or refuse service at its discretion, including but not limited to cases of: (a) safety concerns; (b) inappropriate customer behavior; (c) failure to meet service prerequisites; (d) non-payment of previous services. Booking confirmations will be sent via email and/or SMS to the contact information provided.

3. Cancellation and Rescheduling Policy

Cancellations or rescheduling requests must be made at least 24 hours before your scheduled appointment. Late cancellations (less than 24 hours notice) may result in a cancellation fee equal to 50% of the service cost. No-shows (failure to arrive for a scheduled appointment without prior notice) will be charged the full service price. Repeated no-shows or late cancellations may result in requirement of prepayment or refusal of future bookings. RehealMHA reserves the right to adjust cancellation policies for high-demand periods or specialty services.

4. Payment Terms and Deposits

A deposit may be required to confirm your booking, the amount of which will be communicated at time of booking. The remaining balance is due in full at the time of service unless otherwise agreed. We accept cash, credit cards, and approved digital payment methods. Late payments may result in: (a) service suspension; (b) late fees; (c) referral to collections; (d) legal action for recovery of amounts owed. Returned checks or declined payments may incur additional fees.

5. Refund and Credit Policy

Deposits are non-refundable except in cases where RehealMHA cancels the appointment. Service fees are generally non-refundable once service has commenced. In case of service dissatisfaction, customers may request review within 7 days of service. Any remedies, including partial refunds or service credits, are at the sole discretion of RehealMHA management. Credits issued will be valid for 12 months from issuance and are non-transferable.

Medical Information & Consent

I authorize RehealMHA to collect, maintain, and use my protected health information (PHI) for treatment, payment, and healthcare operations in accordance with HIPAA regulations. I understand that: (a) I am responsible for providing accurate and complete medical history; (b) I must disclose all current medications, allergies, and health conditions; (c) I will inform the provider of any changes to my health status; (d) Treatment recommendations are based on information I provide.

Informed Consent

I understand that healthcare services carry inherent risks and benefits. I have been given the opportunity to ask questions about proposed treatments. I consent to examination and treatment as deemed necessary by the healthcare provider. I understand I may refuse treatment at any time.

Financial Responsibility

I accept financial responsibility for services rendered, including any amounts not covered by insurance. I authorize RehealMHA to bill my insurance and release necessary information for claims processing.

6. Customer Information and Data Collection

By booking with RehealMHA, you authorize us to collect, store, process, and use your personal information including but not limited to: name, phone number, email address, mailing address, date of birth, service history, preferences, health information (where applicable to service), and payment information. This information is used for: (a) scheduling and service delivery; (b) business administration and record-keeping; (c) payment processing; (d) marketing and promotional communications; (e) service improvement and personalization; (f) legal and regulatory compliance. Your data is stored securely using industry-standard practices and will not be sold to third parties. Information may be shared with: (a) service providers necessary for business operations; (b) payment processors; (c) as required by law or legal process.

7. Communication Consent - EMAIL AND SMS

BY BOOKING WITH REHEALMHA, YOU EXPRESSLY CONSENT TO RECEIVE COMMUNICATIONS VIA EMAIL, SMS/TEXT MESSAGE, AND TELEPHONE at the contact information you have provided. These communications include but are not limited to:

Appointment reminders and confirmations
Service updates, changes, and notifications
Promotional offers, discounts, and special events
Customer feedback requests and satisfaction surveys
Important policy updates and announcements
Payment reminders and receipts
Personalized service recommendations

Message frequency varies. Message and data rates may apply. You may opt out of promotional communications at any time by: (a) replying STOP to any SMS message; (b) clicking unsubscribe in emails; (c) contacting us directly at RehealMHA. You may not opt out of transactional communications related to your appointments, payments, or account status, as these are essential to service delivery. By providing your phone number, you confirm you are the account holder or have authorization to consent on behalf of the account holder.

8. Privacy Policy Consent

You acknowledge that you have read and understood our privacy practices. You consent to: (a) collection and processing of your personal data as described; (b) receiving communications as outlined above; (c) storage of your information for business purposes; (d) use of cookies and tracking technologies on our digital platforms. You have the right to: (a) access your personal data; (b) request correction of inaccurate data; (c) request deletion of your data (subject to legal retention requirements); (d) withdraw consent for marketing communications.

9. Limitation of Liability

RehealMHA SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, revenue, business opportunities, data, or goodwill, arising from or related to your use of our services, regardless of the theory of liability. Our total aggregate liability for any claims arising from or related to our services shall not exceed the amount actually paid by you for the specific service giving rise to the claim. This limitation applies to the fullest extent permitted by law. Some jurisdictions do not allow limitation of liability for certain damages; in such cases, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless RehealMHA, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to: (a) your breach of these terms; (b) your violation of any law or third-party rights; (c) your use of our services; (d) any information or content you provide to us; (e) disputes between you and any third party.

11. Dispute Resolution and Arbitration

Any disputes, claims, or controversies arising from or relating to these terms or our services shall first be addressed through good faith negotiation between the parties. If disputes cannot be resolved through negotiation within 30 days, both parties agree to attempt mediation before a mutually agreed-upon mediator. If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the jurisdiction where RehealMHA is located. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Notwithstanding the above, either party may seek injunctive relief in court for violations of intellectual property rights or confidentiality obligations.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the state in which RehealMHA is registered, without regard to conflict of law principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the courts of that jurisdiction.

13. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.

14. Entire Agreement

These terms, together with any service-specific agreements, constitute the entire agreement between you and RehealMHA regarding your use of our services. These terms supersede any prior agreements or communications.

15. Modifications to Terms

RehealMHA reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to our website or notification via email. Your continued use of our services after changes constitutes acceptance of modified terms. Material changes will be communicated at least 7 days in advance when practicable.

You understand and accept the cancellation, deposit, and refund policies
You are at least 18 years of age or have parental/guardian consent if under 18
You accept the limitation of liability and indemnification provisions
You agree to resolve disputes through arbitration as outlined above
